Chupa Chups Lucky Stick promotion
Conditions of entry
1Information on how to enter forms part of these conditions of entry. Participation in this promotion constitutes acceptance of these conditions of entry.
2Entry to the promotion is open to all Australian residents aged 14 years and over who have a current Australian passport which is valid for at least 6 months from 30/10/2008, who are able to take the major prize on the date specified (see paragraph 7), and who fulfill the entry requirements. Directors, management, employees, officers and contractors (and their immediate families) of the Promoter or of the agencies or companies associated with this promotion are ineligible. "Immediate families" means spouse, parent, natural or adopted child, and sibling (whether natural or adopted by a parent), whether or not they live in the same household as the director, manger, employee, officer or contractor.
3The promotion begins on 1/07/2008 and closes last mail delivered 16/08/2008 (Promotion Period).
4To enter, consumers must EITHER:
a) purchase any single Chupa Chups product in one of the following flavours during the Promotion Period:
- Strawberry;
- Orange;
- Cola;
- Watermelon; or
- Blackberry.
After consuming the product, if they find BCN08 printed at the top of the stick (Lucky Stick), they should write their details (full name, street address, email address and daytime contact number) on the back of a stamped envelope into which they have placed their Lucky Stick and send to ‘Chupa Chups Lucky Stick Promotion' PO Box 77 Sydney NSW 2000.
Multiple mail entries are allowed. Each entry must be in a separate envelope. Each entry must relate to a separate Lucky Stick. Each consumer who mails in their Lucky Stick will receive a box of 150 Chupa Chups products (RRP $52.50) for each Lucky Stick received. (Total maximum prize pool value: $15,225)
Note: only the listed Chupa Chups products above which can be purchased singly instore will have a chance of containing a Lucky Stick. NO Lucky Sticks are being placed in multipacks.

b) win a Lucky Stick through the "Hot 30" radio program broadcast on the Austereo network during 22/07/2008 – 25/07/2008 & 28/07/2008.
- From 22/07/2008 – 25/07/2008 (Tuesday – Friday) inclusive, listeners will be given an opportunity to identify a Spanish version of a pop song being played. Calls will be taken until the song is correctly identified. On Tuesday night, there will be two songs played during the broadcast, with two individual winners on this night. From Wednesday to Friday night inclusive, there will be one song played during the broadcast, with one winner on each of these nights. There will be a total of 5 winners. Each winner will win $500 and a mega tin of Chupa Chup products (Total prize pool value: $5,000).
- In addition, on Monday night (28/07/2008), each nightly winner will form a team (Team) with four friends to participate in the ‘Monday Night Lick Off' (Lick Off). Each of the Teams will receive a mega tin of Chupa Chup products which has a coloured spot on the lid (strawberry, orange, cola, watermelon or blackberry coloured). Two of the mega tins have been randomly selected to contain a Lucky Stick. During the Lick Off, Teams have to locate the Chupa Chups product which has the Lucky Stick. The individuals in a Team that locates a Lucky Stick in their mega tin will each win an entry into the major draw. In this way, a maximum of two Teams will win Lucky Sticks (ie a total of 10 entries into the major draw).
- Before the Lick-off commences, the Promoter will also provide representatives of the Promoter who are running this aspect of the Promotion with five envelopes. Each envelope has a coloured spot on the front that matches the coloured spot on each mega tin lid. The envelope with a cola coloured spot is assigned to the Team with the cola coloured spot on the mega tin lid and so on. The Promoter has randomly placed a Lucky Stick in two of these envelopes. If only one Lucky Stick or no Lucky Stick is found during the Lick Off, the representative of the Promoter will randomly open the envelopes one at a time until the required number of Lucky Sticks (either 1 or 2 to allow a total maximum of two Teams to win Lucky Sticks) is found and awarded to the Team(s). The individuals in a Team that has a Lucky Stick found in their envelope will each win an entry into the major draw.
- Where a Team has already found a Lucky Stick in their mega tin during the Lick Off and is therefore already in the major draw, the envelope with their colour on the front will not be opened.
- Team winners who win entry to the major prize draw through these means need to provide their details (name, street address, email address and daytime contact number).
- The remaining three Teams who do not win entry into the major draw will receive a mega tin of Chupa Chups products (Total prize pool value: $1,500).
5Entries must be received by the Promoter during the Promotion Period. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence, whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over networks and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
6The major draw will be conducted at 2:00pm on 22/08/2008 at PublicisMojo Pty Ltd, Bond Store 3, 30 Windmill Street, Walsh Bay NSW 2000.
7The first valid entry randomly drawn will win a trip for two to Barcelona to celebrate Chupa Chups 50th Birthday. The prize includes:
- two return economy airfares to the Barcelona from the winner's nearest Australian capital city (carrier selected by the Promoter);
- return transfers between the hotel/airport in Barcelona;
- five nights' accommodation in a 4 star hotel in Barcelona (standard room, twin share);
- return transfers between hotel/location of celebration; and
- VIP entry to the Chupa Chups 50th Birthday celebration (if a participant is under 18 years, entry will be general admission).
Total major prize value: up to $11,500 (inc GST) depending on the winner's location of residence.
The prize is subject to booking and flight availability, and must be taken on the dates specified by the Promoter (specific date in September 2008 to be determined, although date may vary either side of September). No extension will be permitted.
The winner and friend taking the trip must depart and return at the same time using the same air carrier. Any alterations to confirmed prize details will be at the expense of the winner. The winner is responsible for ensuring that all necessary documentation to travel is obtained (including valid passports and required visas), otherwise the winner's entry will be deemed invalid.
All spending money, meals, taxes, insurance, additional transfers and all other ancillary costs, including any costs associated with passports and visas and costs associated with transport etc from the winner's and friend's place or places of residence to the winner's nearest Australian capital city are the responsibility of the winner.
If the winner of the major prize is under 18 years of age, the major prize will be awarded to the winner's parent or guardian. In the event that one of the people participating or nominated to participate in the major prize is under 18 years of age, a parent or legal guardian of the participant must be present for the duration of the major prize, as one of the participants.
Each participant is required to sign an indemnity in a form approved by the Promoter in favour of the Promoter and all involved parties prior to participating. If they do not sign that indemnity form, they will not be able to participate.
8The winner will be notified by telephone. The winner must confirm their availability to take the selected prize by 5:00pm (Sydney time) 25/08/2008. In the event that the winner (except SA) is unable to take the prize, or has not claimed the prize by 5:00pm (Sydney time) 25/08/2008, then the winner's entry will be deemed invalid and the Promoter reserves the right to conduct further draws at 9:00am on 26/08/2008 at the same location as the original draw to distribute the prize, if permitted by relevant legislation.
In the event that the winner is from SA, written directions will be sought in relation to regulation 37 of the Lottery & Gaming Regulations 1993.
9Winner will be notified by mail and published in The Australian on 27/08/2008 (or 29/08/2008 if a redraw is required/permitted). The Promoter may also publish the name and the State/Territory of residence of winner on its website or in a trade publication. By entering this promotion, each entrant requests that his or her address not be published.
10Total prize value: up to $33,225 (inc GST) depending on the winner's location of residence.
11At the Promoter's request, winner must participate in, and where relevant must procure that the winner's friend participate in, all promotional activity (such as publicity and photography) surrounding the winning of the prize, free of charge, and they consent to the Promoter using their name and image in promotional material.
12The prize is not transferable or exchangeable and cannot be redeemed for cash or any other form of compensation. In the event for any reason a prize winner does not take an element of a prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winner and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize. The value of the prize is accurate as at the commencement of this promotion. The Promoter accepts no responsibility for any variation in the value of a prize after that date. If for any reason a prize is not available, the Promoter reserves the right to substitute another item for it, in its sole discretion, of equal or higher value, subject to the approval of the gaming authorities in each State/Territory, where relevant.
13The Promoter may require a winner to provide proof of identity, proof of age, proof of residency at the nominated prize delivery address and/or proof of compliance with any other eligibility or entry criteria. Identification considered suitable for verification is at the Promoter's discretion.
14If a winning entry is deemed not to comply with the terms and conditions of this promotion, the entry will be discarded and a new winner of that prize will be determined by drawing a further valid entry. The Promoter's decision is final and no correspondence will be entered into.
15If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, mobile network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries, subject to the approval of the gaming authorities in each state and territory, where required.
16The Promoter reserves the right, in its sole discretion, to disqualify all entries from any person, and prohibit that person's further participation in this promotion, who tampers with, or benefits from any tampering with, the entry process or the operation of the promotion or acts in violation of these conditions, acts in a disruptive manner, acts with the intent to annoy, abuse, threaten or harass any person, or fails to provide adequate identification to the satisfaction of the Promoter.
17The Promoter, its associated agencies and companies and the agencies and companies associated with this promotion will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person's negligence) by any person in connection with this Promotion or accepting or using a prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
18The Promoter accepts no responsibility for any tax implications that may arise from the prize winnings. Independent financial advice should be sought. Where the operation of the promotion results in, for GST purposes, supplies being made for non-monetary consideration, entrants agree to follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.
19All entries will be the property of the Promoter. The information entrants provide will be used by the Promoter for the purpose of conducting this promotion. The Promoter may disclose entrants' personal information to its contractors and agents to assist in conducting this promotion or communicating with entrants and to State and Territory lottery departments and winner's name may be published as required under the relevant legislation. The Promoter is bound by the National Privacy Principles in the Privacy Act 1988. Entrants can request access to the personal information the Promoter holds about them by contacting Consumer Services on 1800 244 054.
